This Privacy Policy (the “Policy”) aims to formalize our commitment to respecting the privacy of users of the website www.localflavorists.com (the “Website”), operated by Local Flavorists.

As part of making our Website available, we process your personal data in compliance with the General Data Protection Regulation of 25 May 2018 (the “GDPR”) and under the conditions set out below.

Personal data means any information relating to an identified or identifiable natural person. We collect and process personal data exclusively in connection with the provision of our Services or communications relating to those Services, in strict compliance with the GDPR.

We collect only personal data that is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed. As such, you will never be asked to provide personal data considered “sensitive,” such as data relating to your racial or ethnic origin, political, philosophical, or religious opinions.

By registering on the Website, you authorize us to process your personal data in accordance with this Policy. If you do not agree with the terms of this Policy, please refrain from using the Website and the Services.

1. In what circumstances do we collect your personal data and what data is collected?

We use your personal data to enable the implementation and management of the Services available on the Website and to respond to your specific requests. We also use your personal data for the purposes of operating and improving our Services, our Website, and our overall approach.

1.1 Browsing the Website

Connection data: each time you connect to our Website, we collect personal data such as, in particular, your IP address and certain technical information relating to your device or computer.

Browsing data: we also collect information enabling us to identify how you access the Website, which pages are viewed, and for how long. In this context, we may use cookies, as specified in Section 5 below.

1.2 Payment

As our Services are subject to payment, you agree that we may use external payment service providers (such as Stripe, Google Pay, or Apple Pay), which may collect personal data in order to ensure the proper functioning of credit card payment processing services or any other payment methods.

In connection with the payment of your purchase, you are required to provide certain information strictly necessary for the completion of the order and the provision of our Services, including in particular your email address, first and last name, as well as your payment details, and specifically, in the case of credit card payments, the card number, expiration date, security code, and the name of the cardholder.

We retain information relating to your payments as well as details of the purchases made. Such data may be stored either within our systems or by the relevant payment service provider. This retention is carried out for internal purposes, in particular for accounting, compliance, and legal purposes, in accordance with Section 4 of this Policy.

1.3 Subscription to our newsletter

If you choose to receive emails and messages from us, you will receive electronic communications relating to our products and promotions. For this purpose, we will use the personal data you provided at the time of registration, namely your first name, last name, and email address.

1.4 Contact form

In order to respond to requests you may submit to our Customer Service department and to verify information relating to you, we may use your first name, last name, email address, and telephone number.

1.4 Reviews and testimonials

When you choose to leave a review or testimonial regarding your experience, certain personal data may be collected and processed on that occasion, namely:

  • your first name,

  • the initial of your last name,

  • the content of the review or testimonial you submit.

Such data is collected exclusively on the basis of your voluntary action and is processed for the following purposes:

  • the publication of customer reviews on the Website and/or on Local Flavorists’ communication materials;

  • the improvement of our Services and the experience offered.

You are informed that your review may be published, together with your first name and the initial of your last name, on the Website and, where applicable, on third-party online review platforms (such as Google or any similar platform).

2. How do we protect your personal data?

We have implemented appropriate technical and organizational security measures to ensure the security, integrity, and confidentiality of all your personal data, and to prevent such data from being distorted, damaged, or accessed by unauthorized third parties. We ensure a level of security appropriate to the state of the art, the costs of implementation, and the nature, scope, context, and purposes of the processing, as well as the risks involved and their likelihood.

However, as no security measure is infallible, we are unable to guarantee absolute security of your personal data.

3. In what circumstances do we share your personal data?

3.1 Sharing of your personal data with third-party companies

In connection with the use of the Website and the provision of our Services, certain personal data may be transferred to third-party service providers acting on our behalf, in particular in order to enable:

  • online payments: Stripe, Google Pay, Apple Pay,

  • transactional communications: Zapier, Coupon Carrier,

  • advertising and promotional services: Google Ads, Bing Ads, Meta, TikTok Ads,

  • website traffic analysis: Google Analytics.

These service providers have access only to the data strictly necessary for the performance of their tasks and undertake to process such data solely on our behalf and in compliance with applicable regulations.

Certain data may be transferred to countries located outside the European Union, in particular to the United States. In such cases, these transfers are governed by standard contractual clauses approved by the European Commission, or by any other mechanism ensuring an adequate level of protection of personal data in accordance with the GDPR.

The list of service providers may change. Any significant modification will be reflected in this Privacy Policy.

Under no circumstances are your personal data sold or transferred to third parties for commercial or marketing purposes without your prior consent.

3.2 Sharing with authorities

We may be required to disclose your personal data to administrative or judicial authorities where such disclosure is necessary for the identification, arrest, or prosecution of any individual likely to infringe our rights, the rights of another user, or those of a third party. We may also be legally obliged to disclose your personal data and, in such cases, cannot object to such disclosure.

4. How long do we retain your personal data?

Data relating to order management and contractual relationships is retained for the period necessary to perform the contract and is then archived for accounting and tax purposes for a period of ten (10) years, in accordance with applicable legal obligations.

Data used for communication or marketing purposes (newsletter, contact forms) is retained until the data subject withdraws their consent or, failing that, for a maximum period of three (3) years from the date of the last contact.

At the end of these retention periods, personal data is deleted or anonymized, unless a legal obligation requires its retention for a longer period.

5. Cookies: how do we use them?

5.1 What is a cookie?

A cookie is a text file that may be placed on a user’s device when accessing an online service via a web browser. A cookie file allows its issuer, during its period of validity, to recognize the device concerned each time that device accesses digital content containing cookies from the same issuer.

In any event, cookies placed on your browsing device with your consent are deleted thirteen (13) months after they are placed on your device.
